Section 28
Preparing shortlist of candidates

(1) The party that wants to participate in the election to be held according to the proportional election system must prepare a closed list of candidates representing their party.
(2) According to sub-section (1), when the party prepares the closed list of candidates, the closed list shall be prepared for at least ten percent of the total number of members to be elected under the proportional election system.
(3) When the party prepares the closed list of candidates, the names of at least fifty percent of the total candidates shall be women.
(4) When preparing the closed list of candidates, the party shall not include the name of the candidate in such a way that it exceeds the total number of members determined for the proportional election system.
(5) While preparing the closed list of candidates in accordance with this clause, the party shall also take into account the geographical balance of the respective province and prepare it in accordance with the principle of inclusiveness so that Dalits, tribal tribes, Khas Arya, Madhesi, Tharu, Muslims, backward areas and minority communities are represented as much as possible on the basis of population. .
(6) The party should also include persons with disabilities while preparing the closed list of candidates.
(7) The party shall submit the closed list of candidates prepared in accordance with this section to the Commission within the time specified in accordance with sub-section (3) of section 7 after getting it approved by the central executive committee of the relevant party or a similar committee. After submitting the closed list to the commission, it will be considered that the candidate has been nominated.
(8) When a party submits a closed list of candidates, the person whose name is included in such a closed list must also submit a letter of approval to be a candidate on behalf of that party.
(9) According to sub-section (7) after ascertaining whether the closed list of candidates received from the party has been prepared in accordance with this Act, if it is not prepared accordingly, the commission will inform the relevant party to correct it within seven days.
(10) After being notified by the commission to correct the closed list according to sub-section (9), the relevant party shall amend the closed list of candidates accordingly and send it to the commission within seven days.
(11) SubAccording to section (10), if a closed list of candidates has been submitted but the election has not been completed, if a candidate dies, the party shall include another candidate in such closed list and nominate a candidate. In this way, the candidate who died while nominating the candidate should be nominated on the same inclusive basis as the other candidate.
